Relationship to our Privacy and Social Media Policy. This U.S. State Privacy Notice supplements our Privacy and Social Media Policy and applies to the processing of personal data subject to U.S. state privacy laws (e.g., California, Colorado, Connecticut, New Jersey, Oregon, Virginia). If there is any inconsistency between this Notice and the Privacy and Social Media Policy, this Notice controls. Otherwise, the Privacy and Social Media Policy applies.

 

Introduction

When you play games developed or published by Mytona, visit our websites, or participate in our social media community events, you're sharing a bit of yourself with us. We take this trust seriously and are committed to maintaining it. Understanding our privacy practices is the first step - let us guide you through them in clear, simple terms.

This notice describes the personal data ("data") we collect, how it's used and shared, and your choices regarding this data. Please keep in mind that this notice is not a legal agreement - it's meant to explain how we handle the information we collect when you visit our websites and/or use our services. Scope

This Notice applies to Mytona Limited and its affiliates when we act as a “business” or “controller” under applicable U.S. state privacy laws and process personal data of U.S. residents who interact with us as app users, players, community members, social media followers, or website visitors. This Notice does not cover processing conducted by third parties in their own capacity as independent controllers.

 

Your personal data

What is personal data?

Personal data includes information that identifies, relates to, describes, references, is capable of being associated with, and could reasonably be linked, directly or indirectly, with a particular consumer or device.

How do we get your data?

Mytona collects the following data from these sources:

1. Data provided by users. This includes:

  • Account information. We collect data when users create or update their accounts. This may contain users' names, emails, profile pictures.

  • Demographic data We collect demographic data such as birth date/age, gender when necessary to enable certain features, or provide access to age-restricted products or services.

  • User content We collect data (including chat logs and call recordings) when people contact customer support, provide ratings or feedback, use features that enable users to upload content or submit recordings (including in-app chats), or otherwise contact Mytona.

2. Data collected automatically from users’ devices. This includes:

  • Identifiers We collect various identifiers that identify computers, devices, browsers, vendors, and applications including advertising IDs like Apple's Identifier for Advertisers (IDFA), Google ID, Facebook ID, Appsflyer ID, and in-app identifiers. We also use cookie identifiers on our websites for analytics.

  • Device data We collect data about the devices used to access our services, including the hardware models, device IP address or other unique device identifiers, operating systems and versions, software, preferred languages, advertising identifiers, device motion data, and mobile network data. Some advertising and measurement activities may be deemed “sale” or “sharing” of personal information under California law or “targeted advertising” under certain U.S. state laws. In our mobile apps, if Apple App Tracking Transparency is Denied/Restricted (iOS) or if Android Ads Personalization is turned off / the Advertising ID is deleted (Android), we automatically apply your opt-out from activities deemed “sale,” “sharing,” or “targeted advertising,” and we refrain from accessing the advertising identifier. We also provide a persistent in-app “Your Privacy Choices / Do Not Sell or Share / Targeted Advertising Opt-Out” control to manage these settings.

3. Data created during use of our games. This includes:

  • Usage data We collect data about how users interact with our services. This includes game experience and preferences, access dates and times, app features or pages viewed, browser type, and app crashes and other system activity.

  • Communications data We collect data regarding communications and relationships between users. This includes friendship information, membership in groups and chats in our services and community, content of communications, date/time.

  • Payment information We collect payment information related to the use of our services, including history of accruals of bonuses/compensation, payments (In-app purchases), number of purchases, date and amount of payment, purchase receipt, purchase date and time.

4. Data from publicly available sources. While some states exclude publicly available data from their definition of personal data, we choose to be transparent about all our data practices. We may process:

  • Social media nickname, photo, profile information, dates/times and communications within our communities on social media.

  • Reviews and ratings on social media, including analysis of social media activity and monitoring of brand and project mentions.

  • Community surveys (non-ads). We may conduct community surveys in-game and on social media (e.g., via Google Forms). Participation is voluntary. We collect your survey responses and, where a prize is offered, we may collect your Support ID (internal support identifier) solely to verify eligibility and deliver the prize. After fulfillment, we delete the Support ID and de-identify/anonymize the survey results for analysis.

5. Minors - Advertising Identifiers (not collected). For minors (under 18, or any higher age required by applicable State law), we do not collect, store, or share mobile advertising identifiers (e.g., IDFA, AAID) with third-party advertising or measurement partners, and we do not use such identifiers for profiling or cross-site/app tracking. We also do not show ATT prompts or targeted-ads CMP consent flows to minors. See Sections Children’s Privacy and Your privacy rights (opt-out).

 

How do we use your data?

Use of data. Mytona uses the data we collect:

  • To authenticate and authorize users to play our games.

  • To provide core game functionality:

    • To enable gameplay by creating sessions, saving progress, and storing preferences.

    • To send game-related push notifications.

    • To enable in-app purchases.

  • To improve our services through analytics:

    • To enhance applications and user experience based on behavior patterns.

    • To analyze social media metrics.

    • To study website visitor behavior.

    • To conduct periodic audience research across our platforms.

  • To provide customer support through email and in-game channels, handle technical questions, and manage personal data requests.

  • To maintain application security by monitoring and analyzing suspicious activity and incidents.

  • For marketing purposes:

    • To display targeted advertising of our services across social media, websites, and applications.

    • To show partner advertisements in our applications.

    • To optimize advertising campaigns.

    • To measure marketing campaign effectiveness.

    • To send newsletters about game updates and news.

  • To engage with our social media communities through interactive activities, surveys, and contests.

  • To gather feedback about our services through store reviews and social media monitoring.

  • Some advertising and measurement activities may be deemed “sale” or “sharing” of personal information under California law or “targeted advertising” under certain U.S. state laws. In our mobile apps, if Apple App Tracking Transparency is Denied/Restricted (iOS) or if Android Ads Personalization is turned off / the Advertising ID is deleted, we automatically apply your opt-out from activities deemed “sale,” “sharing,” or “targeted advertising,” and we refrain from accessing the advertising identifier. We also provide a persistent in-app “Targeted Advertising Opt-Out” control to manage these settings.

  • To create personalized offers and pricing (non-ads). We analyze your in-game activity - such as spending amounts and frequency, purchase history, progression/achievements, session patterns, and virtual currency balances - to create user segments and show personalized in-game offers, which may differ in composition and/or price. This constitutes profiling under applicable laws. We do not use special categories of data for this purpose, and we do not make decisions producing legal or similarly significant effects solely by automated means. Minors: personalized offers/pricing are not applied. You can object to this processing at any time via in-app settings (Personalization) or by emailing dpo@mytona.com, and upon objection we will stop such profiling; offers will remain standard or contextual (non-profiled).

 

Data sharing and disclosure

Who do we share your data with?

Mytona may share your data with the following parties:

With other users during gameplay and community events. This includes instances of mutual or public communications and participation in our contests.

With Mytona partners. For example, when users play our games through third-party platforms like Steam, we share only essential data such as authorization details and game session timestamps.

With Mytona subsidiaries and affiliates to help provide our services and process data on our behalf. This sharing enables us to create a seamless gaming experience and allows our players worldwide to connect and play together across all our games and platforms.

With Mytona vendors:

  • Cloud services.
  • Customer support.
  • Identity providers.
  • Analytics services.
  • Advertising services.
  • In-app advertising networks.

Note: We do not sell or share personal data for cross-context behavioral advertising about users we know are under 18. Where you opt out of “sale,” “sharing,” or “targeted advertising,” we propagate that choice to applicable advertising and measurement partners using industry consent signals, and configure our SDKs accordingly.

With social media platforms that host our communities.

With our corporate communication services.

With government entities when legally required, such as in response to a subpoena or other legal process.

With consent: Mytona may share your data in ways not described above if we notify you and receive your consent.

Data Retention

We retain your personal data only as long as needed to provide our services and fulfill processing purposes. While we may continue storing some data after you close your account or stop using our Services, we follow these specific retention periods:

Inactivity. After 5 years of inactivity, we delete your profile and anonymize your data permanently.

Guild retention. We delete player guilds where all members have been inactive for 36 months; associated content is deleted or anonymized unless retention is required by law.

 

Your privacy rights

Your privacy rights and choices may vary depending on your state's legal requirements. Select your state below to see the specific options available to you. Mobile apps (opt-out). In our mobile apps, please use the persistent in-app “Targeted Advertising Opt-Out” control to manage choices. We also honor Apple App Tracking Transparency (iOS) and Android Ads Personalization/Advertising ID settings automatically.

California

The California Consumer Privacy Act, amended by the California Privacy Rights Act provides consumers with the following rights:

  • Right to know what personal information is collected, what personal information is sold or shared and to whom. You can review this information in the Privacy Notice above. If you have additional questions, please contact us at dpo@mytona.com.

  • Right to access and to delete personal information. You can request access to your personal information or deletion of it either through the in-game features or by emailing dpo@mytona.com. You can also specify the request and get a copy of your data that we have processed during the last 12 months.

  • Right to correct inaccurate personal information. You can edit much of your personal information through your in-game account, or by submitting a request to dpo@mytona.com.

  • Right to opt out of sales or sharing of personal information. We may show you personalized ads with the help of third parties. You can opt out of these activities by clicking the "Opt out" button on the banner at the beginning of our games, or by submitting a request to dpo@mytona.com.   • Right to access information about automated decision making and opt out of automated decision-making technology. You can request access to more information about the automated decision-making technology and the availability or opt out by emailing dpo@mytona.com.

  • Right to limit use and disclosure of sensitive personal information. While we strive to minimize the collection and use of sensitive personal information, if you have reasonable grounds to believe we process such data, you can request to limit its use.

  • Right of no retaliation following opt-out or exercise of other rights. We will not discriminate against you for exercising your privacy rights. This means we won't deny you services, charge different prices, provide different service levels, or suggest different rates or quality levels because you exercised your rights.

  • Right to appeal. If we deny your rights request and you live in a state that provides this right, you may appeal that decision. We'll provide the necessary appeal information at the time of denial.

If you are a resident of California, we will honor and process your opt-out request when signaled through the Global Privacy Control (GPC). The GPC signal can only be sent through supported browsers and browser extensions. To download a GPC-compatible browser, click here. Colorado

The Colorado Privacy Act provides consumers with the following rights:

  • Right to access and to delete personal information. You can request access to your personal information or deletion of it either through the in-game features or by emailing dpo@mytona.com.

  • Right to correction. You can edit much of your personal information through your in-game account, or by submitting a request to dpo@mytona.com.

  • Right to data portability. You also have the right to obtain your data in a portable and, where technically feasible, readily usable format that allows you to transfer the data to another entity without hindrance. You can submit a request to dpo@mytona.com.

  • Right to opt out of sale of the personal information, targeted advertising and high-risk profiling. We may show you personalized ads with the help of third parties.   • Right to opt out of the processing of the personal data for targeted advertising, the sale of personal data, and profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning the consumer. If the decision is determined to have been based upon inaccurate personal data, the consumer has the right to have the data corrected and the profiling decision reevaluated based upon the corrected data. Children's Privacy

Beyond legal requirements, we apply additional safeguards to minors under 18: we do not collect or share advertising identifiers (e.g., IDFA/AAID), we do not show ATT prompts or targeted-ads CMP flows, and we do not serve personalized advertising to minors.

Ad availability by age:

  • Under 13: no ads, including rewarded ads. 

  • Ages 13 -17: non-personalized ads only (no profiling; no cross-site/app tracking). 

  • Adults: receive personalized ads only with consent; otherwise ads remain non-personalized.

 

Data Integrity & Security

Mytona has implemented and will maintain technical, administrative, and physical measures that are reasonably designed to help protect your personal data from unauthorized processing such as unauthorized access, disclosure, alteration, or destruction. We strive to apply standards no lower than the rest of the gaming industry. Please keep in mind, though, that the Internet is not 100% secure and any access, disclosure, alteration, or destruction of the personal data you have provided through our Services Games due to breach of our safeguards cannot be ruled out.
